Reimagining Patent Governance for Autonomous Innovation Ecosystems and Machine Assisted Inventorship

Autonomous innovation ecosystems powered by advanced artificial intelligence are transforming how inventions are conceived, optimized, and validated. Traditional patent systems, designed around human creativity and intentional labor, face foundational challenges as machine-assisted inventorship becomes increasingly common. Automated design models, generative algorithms, and self-improving systems now participate in or independently produce inventive outputs, blurring long-standing distinctions between human inventors and technological tools. This paper examines the implications of these transformations for patent governance. It analyzes the inadequacy of existing inventorship criteria, explores the shifting boundaries of ownership and accountability, and proposes conceptual directions for patent systems capable of accommodating autonomous innovation. Ultimately, it argues that modern patent law must evolve toward governance frameworks that acknowledge distributed creativity, hybrid human-machine collaboration, and the emergence of algorithmic inventors.
